RELEASE/WAIVER FORM

In consideration of the acceptance of this application as an athlete participating in the SFA Online Tournaments (“Championship”), I, Master / Ms. [*Name of the Child*] born on [*date of birth*] (“Minor”), through his/her Parent / Legal Guardian / Coach, Mr./Mrs. [*Name*], hereby agree to assume all risks consequent upon the Minor (my ward), while participating in the Championship being organized by SFA Sporting Services Pvt. Ltd. (“SFA”).

We understand the nature of the activities involved in the Championship and the Minor's experience and capabilities and believe the Minor to be qualified, in good health, and in proper physical condition to participate in such a sports tournament. We understand that:

  1. the activities involve risks and dangers of serious injury, including permanent disability, paralysis, and death ("Risks");

  2. these risks and dangers may be caused by the Minor’s own actions or inactions, the actions or inactions of others participating in the Championship;

  3. there may be other risks and social and economic losses either not known to us or not readily foreseeable at this time, and I/we fully accept and assume all such risks and all responsibility for losses, costs, and damages that the Minor/athlete may incur as a result of participation in the Championship;

 

I/We hereby understand that there is a Registration Fees mentioned as a part of the online registration form, which is payable by me/us to SFA, and such fee shall be valid for only the Championship and any ancillary benefits that SFA, in accordance with the Package I/We have signed up for, may provide as a part of such package.

I/We hereby accept that there may be a no-show for a particular category of an event at the Championship. In such a case, the Minor / participant shall be given a walkover. In case of cancellation of the event due to lack of participation, there shall be no award/prize for the particular category of the event. Furthermore, if such an event is the only event that the Minor/participant is participating in at the Championship, the Registration Fee shall not be returned. The Minor under no circumstances shall be permitted to participate in another category of the event.

 

I/We hereby understand that in the event that SFA re-schedules, postpones, and/or cancels the Championship because of substantial damage or destruction to the venue or organization due to any cause, a natural disaster, or action or decree of the governmental body with appropriate jurisdiction (hereinafter referred to as a “Force Majeure Event”), SFA shall immediately give notice to me/us and shall do everything possible to reschedule the Championship and use the registration fee towards such re-scheduled / postponed Championship. No refund of the Registration Fees shall be issued in case of re-scheduling, postponement, or cancellation due to a Force Majeure Event.

I/We hereby further waive, release and discharge all claims for death, personal injury, or property damage which the Minor/participant may suffer, or which may hereafter accrue to the Minor/participant, because of the Minor/participant’s participation/involvement in the Championship.

 

I/We agree to indemnify and hold harmless from any liability/claims SFA and its members, assigns, chapters and/or any of their agents, servants, volunteers, or employees because of an accident, death, injury, or damages, to persons or property which the Minor/participant may suffer, while participating in the Championship.

It is further understood and agreed that this waiver, release, and assumption of Risks shall be binding on our heirs and assigns of the Minor/participant.

I/We agree to assume all responsibilities for any damage to property and/ or injury to any person caused by the Minor/participant while participating in the Championship.

I/We further understand and agree that the Minor/participant shall be photographed and video-graphed (collectively referred to as “Content”), in his/her capacity as a participant of the Championship, and during his/her participation in the Championship. All intellectual property in the Content shall belong to SFA for perpetuity and I/We shall not claim any rights in the Content. Furthermore, I/we authorize SFA to use the Content and also share the Content with sponsors/third parties, in the manner SFA deems appropriate and in accordance with the prevalent laws, in the best interest of the Minor/participant.

I/We hereby undertake that the Minor/participant shall not ingest, swallow, inhale, or otherwise consume any performance-enhancing drugs and/or prohibited substances.

I/We understand and agree that if it is discovered that the Minor/participant has contravened and/or violated this undertaking/stipulation, his/her Registration will immediately be cancelled. The decision of SFA in this regard will be final and binding on the Minor/Participant. In case the Registration of the Minor/participant is cancelled for any reason whatsoever by SFA, the Registration Fee paid by us will be forfeited and we shall have no claim of any kind, or nature against the management of SFA, or its associates.

I/We hereby declare that I/We have read and understood all the terms and conditions, rules, regulations, and stipulations of SFA, and we undertake that the Minor/participant shall unconditionally abide by them.

TERMS AND CONDITIONS

  1. The procedure mentioned for the purpose of filling and submitting the registration form must be strictly adhered to and in the event of any error/default in following such procedure may result in cancellation of the registration.

  2. The registration of the Minor/participant shall be cancelled in the event if all required documents are not submitted.

  3. It is the Minor/participants/parent/guardian/coach’s responsibility to check the list of draws and the final set of rules and regulations, which shall be uploaded on SFA’s official website 5 (five) days prior to the event such athlete is participating in.

  4. Any conflict with regard to the rules shall be addressed by the Sports Committee and such Sport Committee’s decision shall be final and binding on all participants.

  5. Any Minor/participant who does not use appropriate equipment while participating in an event may suffer the risk of disqualification and such disqualification shall be at the sole discretion of the Sports Committee.

  6. There shall be no addition and/or replacement to any team and/or individual participant in an event after the registration deadline.

  7. There shall be no rescheduling or change of time of any event, except as per SFA’s sole discretion and no requests with regard to the same shall be entertained from any Coach, Parent, Guardian, and/or Minor/participant.

  8. In the event any age fraud/manipulation of age proofs, that has been submitted by the Coach, Parent, Guardian and/or the Minor, is discovered by or brought to the attention of SFA, such Minor/participant shall be disqualified from participating in the Championship and further action may be taken at the sole discretion of the Sports Committee and/or SFA authorities.

  9. SFA has a zero-tolerance policy towards any form of Misconduct and any Minor/Parent/Coach and/or person attending the Championship found guilty of Misconduct shall be disqualified to participate in the Championship and/or enter the Championship premises. “Misconduct” shall mean conduct, behavior, activity and/or omission by the Minor, Parent, Guardian, Coach and/or any other person involving one or more of the following:

    • deliberate and serious damage to the SFA’s property; or

    • any breach of these Terms and Conditions; or

    • any act or omission by the Minor/participant which incapacitates the Minor/participant’s ability to participate in the event; or 

    • any act or omission which amounts to violation or non-compliance with the rules of the sport as uploaded by SFA on its official website; or

    • any act or omission amounting to violation or non-compliance with all applicable laws of India, including without limitation, central laws, state laws, municipal laws; or

    • any act or omission which impairs public confidence in, and/or brings disrepute to SFA, the Championship and/or the sports being played at the Championship; or

    • accepting (or failing to report the offer of) a bribe, attempting to or consenting to fix or manipulate, the result, score, progress, conduct or any other aspect of the Championship and/or any match or part thereof or any other match, betting on any match (whether himself or via a third party) and/or knowingly associating with match gamblers or other match gambling activity; or

    • use and/or supply of banned stimulants and/or other banned drugs and substances as per the anti-doping regulations of the World Anti-Doping Code as released by WADA and amended from time to time; or

    • such other similar or equivalent serious or persistent conduct, activity, or omission by the Athlete which SFA reasonably considers as amounting to misconduct.

  10. theft or fraud or accusation of any crime involving moral turpitude; or

  11. The events under the Championship shall be governed and monitored by a Dispute Resolution Committee, by whatsoever name it may be called. All protests shall be submitted to such Dispute Resolution Committee, in writing, along with the protest fee of Rs. 1000 within 24 hours of the issue of protest coming to the attention of such a protesting party. The Dispute Resolution Committee shall resolve all disputes within a period of 48 hours. The protest fee shall be refunded in the event the protest is accepted and upheld and in the event of a false claim/accusation, there shall be no refund of such protest fee. No protests, except those submitted in accordance with the procedure as mentioned herein, shall be entertained by the Dispute Resolution Committee and/or SFA.

  12. As mentioned, SFA shall have the right to photograph and/or film all matches, however, SFA is not obligated to provide to any Coach, Parent, Guarding, and/or Minor such photographs and/or video.

  13. The nature of sport involves risks and SFA shall not be held liable in case of death, personal injury, or property damage which the Athlete may suffer because of the Athlete’s participation/involvement in the Championship.

  14. SFA shall not be responsible for any goods/property that may be lost during participation in the Championship and the Minor/participant shall be solely responsible to safeguard his goods/property.

  15. The distribution of prizes/gratification shall be done at a scheduled time notified by SFA in advance and in the event any Minor/participant fails to attend such gratification ceremony at the scheduled time, the gratification shall be handed over to the Minor/participant, if any, at the end of the Championship.

  16. It is the Minor/participants/parent/guardian/coach’s responsibility that he does not participate in a match and/or event that he is not entitled to play in accordance with the draws and if such an event is brought to the attention of SFA, the Minor/participant shall be at the risk of disqualification.

  17. A walkover shall be given in the case of no-show of the opponent and in the event there is disqualification of an opponent i.e. the Minor/participant shall then progress to the next round, however, under no circumstances shall the Minor/participant be eligible to participate in a category that he is not eligible to participate in.

  18. The Minor/participant must arrive at the Championship one hour prior to the start of the event.

  19. SFA shall not be responsible for any incorrect details that may be mentioned on the Minor/participant’s profile due to human error, however, SFA shall do its best to correct/rectify such facts once brought to their attention.
